ChocoLamour Terms & Conditions
In these conditions:
"Buyer" means the person who accepts a quotation of the Seller for the sale of the Goods or whose order for the Goods is accepted by the Seller.
"Conditions" means the standard terms and conditions of sale set our in this document and include any special terms agreed in writing between the Buyer and the Seller.
"Goods" means the goods which the Seller is to supply to the Buyer under these Conditions as specified in the website.
"Seller" means ChocoLamour.
"The Website" means www.chocolamour.co.uk
1. Orders and Specifications
1.1 Orders are deemed to be accepted when payment has been received in full and the order has been checked, approved and a confirmation email sent to the email address used when placing the order. If there is a problem the Buyer will be contacted.
1.2 The Buyer shall be responsible to the Seller for ensuring the accuracy of any special terms of any order, and for giving the Seller any necessary information relating to the Goods to enable the Seller to fulfil the order.
1.3 The quantity, quality and description of and any specification for the Goods shall be those set out in the Seller's quotation as described on the Website, or for special orders as described in writing.
1.4 You (the Buyer) have the right to cancel your order at any time up to seven working days from the day after receiving the goods. You may cancel in writing, by e-mail or post to the addresses given in the 'Contact Us' page. We guarantee to refund the full purchase price within 30 days of cancellation. Any such unwanted goods remain the property of ChocoLamour and must be returned to us at your own expense, unopened and in perfect condition. If they are not returned we will collect them and deduct the direct cost from the refund. Refunds will only be made to the original credit/debit card account or by cheque made payable to the original cheque signatory. This guarantee is in addition to your statutory rights as a consumer. The right to cancel your order does not apply to personalised goods. If you have selected ribbon colour, specific chocolates or chocolate writing this constitutes personalisation and so the order cannot be cancelled.
1.5 In the unlikely event that we cannot satisfy your order due to stock unavailability, we will attempt to contact you to arrange an alternative. If we cannot contact you, or this would prevent us from meeting your required delivery date, we will subsitute the product for one of a similar description and of the same or higher value, and notify you as soon as possible.
1.6 Products are handmade and as such may vary slightly from the pictures on the website, or indeed from previously ordered products. Ribbons, boxes and wrappings will vary depending on supply, changes and availability. Every attempt will be made to ensure that the goods displayed on this website are a true representation of the goods sent. There may be occasions when we have no alternative but to substitute any part of an order for an alternative.
1.7 If you have purchased chocolates from ChocoLamour with which you are not entirely happy, please contact us within 7 days of receipt of the products. We will consider your complaint and will do all we can to rectify the situation. We endeavour to respond to all complaints within 7 working days. We may need you to return the product, and if we do it will be at your own cost. Return postage will be refunded if we agree that the goods are 'sub-standard'.
1.8 Some of our chocolates contain nuts and all can contain traces of nuts.
2. Delivery
2.1 Delivery is charged in addtion to the product price. The total price payable, including delivery, will be displayed on the order confirmation screen. The displayed price is the amount in pounds sterling.
2.2 All deliveries are made by Royal Mail 1st class postal service. Delivery can only me made to UK addresses. Please ensure that you provide us with a full and accurate address including the correct postcode. We are unable to accept orders to addresses containing a PO Box number or FREEPOST addresses unless with prior arrangement. Delivery will be made to the adress of the Buyer unless otherwise specified at the time of placing the order.
2.3 If the Buyer fails to take delivery of the Goods or fails to give the Seller adequate delivery instructions (otherwise than by reasons beyond the Buyer's reasonable control or by reason of the Seller's fault) then the goods will be dealt with by Royal Mail as standard. If the goods are returned to us we will attempt to contact you to offer re-delivery at your cost.
2.4 If the Seller fails to deliver the Goods for any reason other than any cause beyond the Seller's reasonable control or the Buyer's fault, and the Seller is accordingly liable to the Buyer, the Seller's liability shall be limited to the difference (if any) between the price of the Goods and the cost of similar replacement goods (in the cheapest available market).
2.5 Any dates quoted for delivery of the Goods are approximate only and the Seller shall not be liable for any delay in delivery of the Goods however caused. The Goods may be delivered by the Seller in advance of the quoted delivery date upon giving reasonable notice to the Buyer.
2.6 Whilst every effort is made to ensure the goods reach you in perfect condition ChocoLamour cannot take responsibilty for products lost or damaged in transit.
2.7 We will always endeavour to dispatch your order within 5 to 7 days of order (apart from items purchased from our Wedding Range - we will contact you to advise the expected delivery date). If you need delivery urgently, please email in advance of order (to info@chocolamour.co.uk) and we will make every effort to meet your requirements.
2.8 Orders may be placed in advance. For example if you have a specified delivery date this can be accommodated. Please use the Contact Us page, or the additional notes space at the checkout to advise this.
3. Payment
3.1 The Buyer shall pay in full at the time of order. The order is deemed to be accepted by the Seller when payment has been received in full, the order details have been checked and a confirmation email has been sent to the Buyer.
3.2 The total value of your order will be displayed on the order confirmation screen. The displayed price is the amount in pounds sterling.
3.3 Payment can be made by Visa, MasterCard, Switch, Solo, Discover, American Express and PayPal Express Checkout. Payments are processed using RomanCart through Paypal.
3.4 We reserve the right to obtain further security information from our customers for orders over a set price. Please note this may affect the arrival date of your order should we be unable to contact you.
3.5 We reserve the right to cnacel your order if one or more of the products you ordered was listed at an incorrect price due to a typographical error. If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
4. Price
4.1 The price of the Goods shall be the Seller's quoted price as described on the website.
4.2 The Seller reserves the right, by giving notice to the Buyer at any time before delivery, to increase the price of the Goods to reflect any increase in the cost to the Seller which is due to any circumstances beyond the reasonable control of the Seller (such as, without limitation, any foreign exchange fluctuation, alteration of duties, significant increase in the costs of labour, materials or other costs of manufacture), any change in delivery dates, quantities or specifications for the Goods which is requested by the Buyer.
4.3 No value added tax is charged on, or included in, product prices. This may change without notice.
4.4 Prices may change without notice.
4.5 Any special offers made are designed to be used independently, and are not available in conjunction with any other offer.
5. Warranties and liability
5.1 For goods ordered with certain specifications the Seller shall be under no liability in respect of any defect in the Goods arising from any drawing, design or specification supplied by the Buyer.
5.2 Any claim by the Buyer which is based on any defect in the quality or condition of the Goods or their failure to correspond with specification shall be notified to the Seller within 7 days from the date of delivery. If the Buyer does not notify the Seller accordingly, the Buyer shall not be entitled to reject the Goods and the Seller shall have no liability for such defect or failure, and the Buyer shall not be eligible for a refund.
5.3 Where any valid claim in respect of any of the Goods is notified to the Seller, the Seller shall be entitled to replace the Goods free of charge or, at the Seller's sole discretion, refund to the Buyer the price of the Goods, but the Seller shall have no further liability to the Buyer.
5.4 The Contract shall be governed by English Law.
5.5 These Terms and Conditions do not affect your statutory rights.
6. Data Privacy
6.1 When you visit or order products or services on www.chocolamour.com you may be asked to provide certain information about yourself including your name, contact details and credit or debit card information. We may also collect information about your usage of our website as well as information about you from e-mails or letters you send to us. To maintain customer service standards and to assist staff training, we may record and monitor incoming calls.
6.2 Your information will enable us to provide you with access to all parts of our website and to supply the goods or services you have requested. It will also enable us to bill you and to contact you where necessary concerning your orders. We will also use and analyse the information we collect so that we can administer, support, improve and develop our business. We may use your information to contact you for your views on our services and to notify you occasionally about important changes or developments to the website or our services. If you wish not to be contacted contact us to advise this.
6.3 By submitting your information you consent to the use of that information as set out in this policy. If we change our privacy policy we will post the changes on this page so that you may be aware of the information we collect and how we use it at all times. We may also e-mail you if we make any changes so you may consent to our use of your information in that way. Continued use of the service will signify that you agree to any such changes.
